Mr. Buckwalter is a member of the Firm’s Litigation Department of Niles Barton  and represents clients in a broad variety of cases across Maryland and the District of Columbia.  Brett draws on his 20 years of litigation experience in both private practice and as an in-house attorney, to help businesses and individuals overcome a myriad of legal issues.  Through this experience, Brett focuses on tailoring his representation to the client’s specific needs, working toward an effective resolution in an efficient and timely manner.  He is rated AV­ Preeminent® by Martindale-Hubbell, awarded by peer review, for the highest standards of professional skill and ethics.

Brett has extensive experience representing insurance companies and their insureds, including professionals and businesses in all matters of litigation.  This includes representing realtors, settlement agents, title abstractors, attorneys, mortgage and title companies, and insurance agents against claims of professional negligence and deceptive trade practices. He also defends individuals and business against wrongful death and serious bodily injuries claims, including claims arising out of premises liability, automobile accidents, and products liability. 

In addition, Brett represents businesses in various commercial and employment litigation matters, including employment discrimination claims, non-competition and trade secret disputes, and commercial contract disputes.

Mr. Buckwalter chairs the firm’s Employment Law practice, regularly counseling businesses on employment and personnel issues, drafting effective workplace policies and manuals, and complying with federal, state, and local employment laws. He also works regularly with clients to develop and maintain effective and proactive risk management policies to limit the number of employee or third party claims that may be made in the future and to ensure thorough and accurate investigation procedures are in place so that the client will be able to most effectively defend unavoidable claims that arise.

Brett returned to Niles Barton after spending 3 years as an in-house litigation attorney at a leading national personal installment lender, where he defended the company against all types of consumer claims, where he gained extensive experience defending claims arising under state consumer protection, fair lending, and debt collection laws, as well as federal laws such as the FCRA, TCPA, TILA, FDCPA, and Bankruptcy laws.  During this time, he also regularly worked on matters with outside counsel, gaining an invaluable perspective from the “client’s view”” relating to the importance of effective communication and collaboration between business and their counsel throughout the litigation experience.

Mr. Pollock assists clients in navigating state, federal, and international data security and privacy laws. He has represented clients in a pro bono capacity as a member of the Maryland Volunteer Legal Service. He has served as a judicial law clerk to the Honorable Philip S. Jackson of the Circuit Court.

Mr. Shaw is a Partner in the Corporate Department of Niles, Barton & Wilmer, LLP. He has over 25 years of experience as an in-house corporate and regulatory attorney in the securities and insurance industries. He serves the legal, compliance and enforcement defense needs of registered investment advisers, broker-dealers, hedge funds, private equity firms, and insurance agencies.

He also advises business owners in general representation matters, including counseling clients through all stages of the business cycle, including formation, employment, mergers and acquisitions, and succession planning.  Mr. Shaw is admitted to practice in Maryland, the District of Columbia, and the U.S. District Court for the District of Maryland.      

Mr. Shaw holds leadership positions on the CFA Society Baltimore Board of Directors, and as the Board Advocacy Chair.  He is also the Secretary/Treasurer of Business Networking International. 

Prior to joining Niles Barton, he founded The Shaw Law Group, LLC, a firm that provides compliance and risk management advice, and regulatory enforcement counsel. Previously, Mr. Shaw was in-house counsel for CFP Board, FINRA, and Monumental Life Insurance Company, where he gained experience in securities and insurance regulations, litigation, and corporate governance.

Keith O. Hinder, Jr., Associate


As an associate attorney in the Real Estate Department at Niles, Barton & Wilmer, LLP, Mr. Hinder represents clients in commercial real estate matters and real estate litigation. He also has experience in general commercial litigation, construction litigation, employment litigation, insurance coverage matters and insurance law within the state of Maryland, assisting clients in developing legal strategies to avoid litigation whenever possible.

Mr. Hinder is an active member of the American Bar Association, the Young Lawyers Section of the Maryland State Bar Association, The Young Lawyers Division of the Bar Association of Baltimore City, and the Anne Arundel and Harford County Bar Associations. He is also a member of NAIOP MD Developing Leaders, USGBC Maryland and the Urban Land Institute. Mr. Youssef is a partner in the firm’s Corporate Department. He has experience advising community associations, restaurants, technology startups, and businesses engaged in government contracting on business law issues. He has handled a wide variety of contract negotiations, employment issues, trademark litigation, and business disputes.

Matthew regularly helps clients develop a plan to protect their intellectual property and has worked with online and brick-and-mortar retailers to guard against unfair competition and trademark infringement, successfully litigating injunctions to cease infringements when necessary. Throughout the life of the business or brand, he mitigates the need for litigation by acting quickly and assertively to ensure its success.

Matthew also advises emerging growth companies on corporate governance and legal issues relating to equity compensation, employment agreements, commercial leases, and litigation that arises from commercial disputes. He regularly drafts service contracts, terms of service, privacy policies, and software license agreements.

With broad and deep litigation experience throughout the Mid-Atlantic region, Matthew helps clients resolve unexpected legal issues and is frequently called upon to provide advice on their most challenging problems that require creative and unconventional solutions. His experience ranges from intervening in bankruptcy cases to enforcing creditors’ rights to seeking injunctions to protect intellectual property.

In the world of government contracting, Matthew has helped his clients both large and small navigate the procurement process, resolving bid protests, and appeals. Matthew will frequently assist clients with Minority Business Enterprise (MBE), Disadvantage Business Enterprise (DBE) or Small Business Enterprise (SBE) certifications.

Matthew has been named by Maryland Super Lawyers to the Rising Star List for Business Litigation from 2013-2019. He has also been recognized by the Maryland Daily Record for “20 in their Twenties” award in 2011 and for the “Maryland VIP List – Successful by 40” in 2016 for professional achievement and civic involvement. He was recently selected to participate in the Greater Baltimore Committee (GBC) Next Up 2019 program, focused on professional development, leadership training, and networking opportunities for young leaders from across Baltimore region’s industries and sectors who have been identified as the next generation of leaders by their organizations.

Prior to law school, Matthew volunteered as a residential counselor with Boys Hope Girls Hope of Baltimore, where he served as a live-in AmeriCorp Volunteer. He helped found Boys Hope Girls Hope’s Young Professional Committee and briefly served on the Advisory Board for Harlem Park Elementary Middle School located in the Sandtown-Winchester neighborhood of Baltimore. Mr. Wothers practices in the Litigation Department of Niles, Barton & Wilmer, LLP, concentrating in insurance coverage litigation, property insurance law, related first party insurance matters and commercial litigation. His experience includes investigation and litigation in various first party areas, including coverage disputes, arson and fraud investigations across North America.

In addition to representing many domestic carriers, Mr. Wothers represents a significant number of syndicates in the world's leading specialist insurance market: Lloyd's of London. He works with underwriters, brokers, managing general agents and third party administrators to handle excess and surplus lines insurance coverage, reinsurance, representations and warranties insurance, and litigation in the mid-Atlantic United States.

Mr. Wothers has lectured extensively regarding investigation of fraudulent claims, insurance coverage, and first party property appraisal. He also has extensive experience in subrogation. His liability/third party practice includes construction defect matters and commercial litigation involving business-related matters. Mr. Wothers practices in the state and federal courts of Maryland, Pennsylvania, Virginia, West Virginia, North Carolina, New York and the District of Columbia.

Mr. Wothers serves on the Firm's Management Committee, and previously served as Managing Partner for seven years. Mr. Wothers is a member of the American Bar Association's Property Insurance Law Committee, and the Tort Trial and Insurance Practice sections. He is also a member of Defense Research Institute. 

Mr. Wothers was recognized by Maryland Super Lawyers as a top attorney in Insurance Coverage and Business Litigation from 2008-2019. Mr. Wothers was profiled in the 2012 edition of Maryland Super Lawyers magazine in an editorial titled, "Insurance Exchange." George Reede serves as the Chairman of the Litigation Department at Niles, Barton & Wilmer, LLP. Mr. Reede regularly advises insurers on a variety of insurance coverage issues in the state of Maryland, Virginia, and the District of Columbia.

Coverage Analysis

Effective coverage analysis involves knowing how to apply policy language to the unique facts of each case. Having co-authored a commercial property insurance policy, Mr. Reede has a unique perspective on insurance policy interpretation. His experience as coverage counsel has included:

  • A wide variety of property insurance coverages, including computers and media, civil authority, builders risk and business interruption;
  • Many different businesses and industries, including chemical manufacturers, professional sports teams, airports and convention centers;
  • Over a thousand examinations under oath, many involving suspected insurance fraud.

Litigation

Even the best coverage decisions are still subject to challenge, and litigation can be unavoidable. Mr. Reede has effectively represented insurers in federal and state courts, at both the trial and appellate level, and in administrative hearings. In addition to the published cases referenced below, his experience includes:

  • Complex property coverage litigation involving loss of income claims at 58 airports across the country, all arising from the events of 9/11;
  • A variety of coverage cases relating to natural disasters;
  • Declaratory judgment actions regarding the duty to defend and indemnify;
  • Subrogation litigation involving significant explosion, fire and water losses;
  • Administrative proceedings arising from complaints under Maryland's Unfair Claim Settlement Practices Act;
  • National and international discovery, including depositions in 30 states, Israel, England and Canada

Training Resource

Mr. Reede regularly provides training as a service to his clients. This has included classes offered through CEU Institute for adjuster licensing requirements on topics such as ethical claims management, wind claim causation analysis, mold claims, and insurance fraud detection. Mr. O'Brien's practice is focused upon the defense of claims in commercial litigation. He has had extensive experience in defending maritime claims (including cargo damage, collision, personal injury, and death), inland marine claims, non-maritime trucking industry claims (including cargo damage, personal injury, death and coverage issues), claims involving warehousemen, freight forwarders, transportation brokers and terminal operators, as well as claims involving commercial contract disputes. He has served on the firm's Management Committee and as Chairman of the firm's Litigation Section.

He is a member of the American Bar Association, the Maryland State Bar Association, the Baltimore City Bar Association, the Defense Research Institute and the DRI Trucking Law Committee. Mr. O'Brien has been a proctor member of the Maritime Law Association of the United States since 1981 and he is currently a member of the MLA's Maritime Torts and Casualties Committee. Mr. Mannes is a Partner in the Real Estate Department of Niles, Barton & Wilmer, LLP. His practice includes all phases of real estate with a concentration in the development and creation of condominium and planned unit developments, in addition to representation of condominiums, homeowners' associations and cooperatives in the areas of dispute resolution, construction and governance issues. Prior to joining Niles Barton, Mr. Mannes was a solo practitioner for fourteen years.

Mr. Kimball is Chair of the Commercial Real Estate Department of Niles, Barton & Wilmer, LLP. His practice includes real estate, real estate finance, leasing, property management and real estate-related environmental law. He is a frequent speaker and is a contributor to industry journals, writing on leasing, property management and other real estate issues. Mr. Kimball is the co-author of the text Property Manager's Guide to Commercial Real Estate Law, published by the BOMI Institute. Mr. Kimball is a member of the American College of Real Estate Lawyers (ACREL) and is a Fellow of the American College of Mortgage Attorneys, serving as Past Chair for State of Maryland. He is also a member of the NAIOP DC|MD, Urban Land Institute and the International Council of Shopping Centers.

Mr. Kimball was selected to the Maryland Super Lawyers List from 2008 - 2019 in the area of Real Estate. He has also been peer-selected for inclusion in The Best Lawyers in America® in the area of Real Estate Law from 2014-2020.

Kimball currently serves as President of the Board of Directors for the Baltimore Chapter of Lambda Alpha International (LAI). He also serves on the Board of the Episcopal Housing Corporation in Baltimore.

Ms. Baker is a partner in the Corporate Department of Niles, Barton & Wilmer, LLP. She represents business clients and emerging growth companies in a full range of matters, including entity formation and modification, owner agreements, contract review and negotiation, real estate, and, in particular, trademark and copyright issues. She also has a concentration in health care, assisting many types of health care providers in business and contracting matters. In addition, she advises and supports healthcare service providers.

Ms. Baker serves as the firm's Pro Bono Partner, leading a firm-wide strategic initiative to expand pro bono opportunities for attorneys. She is also chair of the Women's Committee at Niles Barton.

Ms. Baker is extremely active in her community. She assists growing businesses through the Maryland Small Business Development Center’s CEO Accelerator Program, and she mentors two high school students through Sister’s Circle, a mentorship-focused nonprofit based in Baltimore.
